Terms of Service (Terms of Use & EULA)
Effective Date: November 2026 · Application: Saphirium (Developer: devSergioSS)
1. Acceptance of Terms
These Terms of Service, Terms of Use, and End-User License Agreement (“Terms”) form a binding legal agreement between you (“User” or “you”) and devSergioSS (“Developer”, “we”, “us”, or “our”) governing your installation and use of Saphirium (also published on the Microsoft Store as “Saphirium: Desktop Planner Widget — Calendar, Tasks & Sync”, official website https://saphirium.app), including any updates and documentation (“the Application”). Your use of the Application is also subject to our Privacy Policy.
2. License Grant & Restrictions
Subject to your compliance with these Terms and applicable Microsoft Store rules, Developer grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Application on Windows devices that you own or control, in accordance with the Microsoft Store Usage Rules.
- You may not copy, reverse-engineer, decompile, disassemble, modify, rent, lease, lend, redistribute, or create derivative works of the Application, except to the extent such restrictions are expressly prohibited by mandatory applicable law.
- You may not use the Application in any manner that violates applicable laws, third-party rights, or Google / Microsoft API terms of service.
3. Purchases, Regional Pricing & Refunds via Microsoft Store
When acquired through the Microsoft Store, all billing, currency conversion, regional pricing, applicable taxes, and refund requests are processed exclusively by Microsoft Corporation under the Microsoft Services Agreement and Microsoft Store Terms of Sale. Developer does not process payments directly and cannot issue refunds outside Microsoft Store’s billing system.
4. Third-Party Services & Independence
Optional synchronization features rely on third-party services such as Google Calendar API and Google Tasks API, and meeting links may open third-party platforms such as Google Meet, Zoom, or Microsoft Teams. Saphirium is an independent product and is not affiliated with, sponsored by, or endorsed by Google LLC, Microsoft Corporation, or Zoom Video Communications, Inc.
Developer has no control over third-party APIs or operating system interfaces. We shall not be liable if any third-party provider modifies, rate-limits, restricts, charges for, suspends, or discontinues its APIs or services, even if doing so degrades or disables synchronization features of the Application.
5. Disclaimer of Warranties (“AS IS” & “AS AVAILABLE”)
6. Non-Reliance for Critical Events & User Backups
- No High-Risk or Critical Reliance: Desktop notifications, alarms, background polling, and offline sync queues depend on Windows power states (sleep/hibernation), Windows Focus Assist / Do Not Disturb settings, battery optimization, network availability, and external APIs. Saphirium is a general productivity aid and is not designed or intended for safety-critical, medical, aviation, emergency, legal/court deadlines, tax filings, financial trading, or high-risk obligations. You agree not to rely solely on Saphirium for critical schedules or deadlines.
- User Responsibility for Backups: Local data is stored on your device (
%APPDATA%), and synced items modify your connected Google account directly. You are solely responsible for maintaining independent backups of important calendar events and tasks. Developer is not responsible for accidental deletions, sync conflicts, corrupted caches, OS crashes, or hardware failures.
7. Limitation of Liability & Cap on Damages
IN ALL CASES, DEVELOPER’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APPLICATION OR THESE TERMS SHALL NOT EXCEED THE LESSER OF: (A) THE ACTUAL AMOUNT PAID BY YOU FOR THE APPLICATION DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIVE UNITED STATES DOLLARS (USD $5.00). SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS OR LIABILITY LIMITATIONS; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MINIMUM EXTENT REQUIRED BY MANDATORY CONSUMER LAW.
8. Indemnification & Severability
To the extent permitted by law, you agree to indemnify and hold harmless Developer from and against any third-party claims, liabilities, damages, or expenses arising from your misuse of the Application or violation of these Terms. If any provision of these Terms is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
9. Changes to Terms & Contact
We may update these Terms periodically by posting a revised version on this page. Continued use of the Application after changes take effect constitutes acceptance of the revised Terms.
